This Acceptable Use Policy ("AUP") governs your use of the Gift-a-Roast website, mobile applications, API, phone services, SMS messaging, and all related services (collectively, the "Service") operated by IT Pro Partner LLC ("Gift-a-Roast," "we," "us," or "our"). By accessing or using the Service, you agree to comply with this AUP.

1. Prohibited Content

You may not use the Service to create, send, transmit, or request content that:

• Harassment & Threats: Contains threats of violence, stalking, doxing, or targeted harassment of any individual or group.
• Hate Speech: Promotes violence, hatred, or discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Illegal Activity: Facilitates, promotes, or instructs in illegal activity, including but not limited to fraud, identity theft, or criminal offenses.
• Sexually Explicit or Obscene: Contains pornography, sexually explicit material, or obscene content.
• Exploitation of Minors: Depicts, references, or targets minors in a sexual, abusive, or exploitative manner. Any such use will result in immediate termination and referral to law enforcement.
• Impersonation: Impersonates another person or entity in a manner intended to deceive, mislead, or cause harm.
• Malicious Content: Contains malware, viruses, phishing links, or any code or material designed to harm, interfere with, or compromise any system or data.
• Spam & Unsolicited Communications: Constitutes bulk unsolicited messaging, robocalls, or spam via phone, SMS, or any other channel.

2. Prohibited Conduct

You agree not to:

• Use the Service to harass, abuse, intimidate, or threaten others.
• Attempt to bypass any content filters, rate limits, or security measures we implement.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
• Use the Service for automated scraping, data mining, or unauthorized API access.
• Resell, sublicense, or redistribute access to the Service without our prior written consent.
• Use the Service to send calls or messages to individuals who have not consented to receive them, or who have explicitly opted out.
• Interfere with or disrupt the Service, its servers, or networks connected to the Service.
• Submit the phone number of any individual who has not consented to receive a roast call, sweet note, or other communication from the Service.

3. SMS & Phone Communications

The Service includes SMS and phone call features. When using these features, you agree to the following:

• Consent Required: You must obtain the recipient's prior express consent before submitting their phone number for SMS messages or phone calls through the Service.
• No Automated Dialing: You may not use the Service as part of any automatic telephone dialing system (ATDS) or for telemarketing purposes without our explicit written authorization.
• Identification: All messages and calls initiated through the Service will identify Gift-a-Roast as the sender/caller where technically feasible.
• 10DLC Compliance: SMS messages are sent via 10-Digit Long Code (10DLC) registered through The Campaign Registry. By using our SMS features, you acknowledge that your messages are subject to carrier filtering and throughput limitations.

4. Enforcement

We reserve the right, but do not assume the obligation, to investigate any violation of this AUP. Consequences of a violation may include, at our sole discretion:

• Removal of prohibited content
• Suspension or termination of your access to the Service
• Reporting to law enforcement authorities where appropriate
• Legal action to recover damages or obtain injunctive relief

Privacy Policy

This Privacy Policy describes how IT Pro Partner LLC ("Gift-a-Roast," "we," "us," or "our") collects, uses, and protects your personal information when you use the Gift-a-Roast website, applications, phone services, and SMS messaging (collectively, the "Service").

1.1 Information You Provide

• Account Information: When you create an account, we collect your name, email address, and password (hashed).
• Order Information: When you place an order, we collect the sender's name and email, the recipient's name and phone number, the "ammo" or personalization content you provide, and the product type selected.
• Payment Information: Payment card details are processed by our third-party payment processor (Stripe) and are never stored on our servers. We retain only transaction identifiers and the last four digits of the payment card for reference.
• SMS & Phone Data: Phone numbers you submit for message and call delivery, the content of messages sent, and call metadata (duration, timestamp, status).

1.2 Information Collected Automatically

• Usage Data: IP address, browser type, device information, pages visited, and interactions with the Service.
• Call Data: Timestamps, call duration, call status (answered, voicemail, failed), and carrier routing information for all phone calls initiated through the Service.
• Cookies: We use essential cookies for session management and security. We do not use tracking cookies for advertising purposes.

2. How We Use Your Information

We use the information we collect for the following purposes:

• Service Delivery: To process orders, place phone calls, send SMS messages, and deliver the content you create.
• Account Management: To create and maintain your account, authenticate your identity, and provide customer support.
• Billing: To process payments and maintain transaction records.
• Communications: To send order confirmations, delivery notifications, and respond to your inquiries.
• Improvement: To analyze usage patterns and improve the Service.
• Legal Compliance: To comply with applicable laws, regulations, and legal process, including carrier requirements under 10DLC and CTIA guidelines.

3. SMS & Phone Number Privacy (10DLC Compliance)

Specifically:

• Consent: By submitting a phone number, you represent that you have obtained the recipient's prior express written consent to receive the communication. For SMS messages, this consent meets the requirements of the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.
• Opt-Out: Recipients may opt out of future SMS messages at any time by replying STOP. They may also reply HELP for assistance or contact us at [email protected]. Opt-out requests are processed immediately.
• Message Frequency: Message frequency varies based on order volume. You control when and how many messages are sent.
• Carrier Disclosure: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• No Mobile Information Sharing: We do not share, sell, rent, or trade mobile phone numbers or SMS consent with any third party for marketing or promotional purposes. Phone numbers are used exclusively for delivering the communications you request through the Service.
• Data Retention: Phone numbers and associated call/SMS metadata are retained only as long as necessary to fulfill the service and comply with legal obligations.
• Call Recordings: We do not record the content of phone calls unless explicitly stated at the time of service. Roast Line interactive sessions may retain transcripts for quality assurance.

4. How We Share Your Information

We do not sell, rent, or trade your personal information. We share information only in the following circumstances:

• Service Providers: With vendors who help us operate the Service, including Twilio (telephony and SMS delivery), ElevenLabs (voice synthesis), Deepgram (speech-to-text), Stripe (payment processing), and our AI model provider (content generation). These providers are contractually bound to use your data only as directed by us.
• Legal Requirements: When required by law, court order, or governmental authority.
• Business Transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
• Protection of Rights: To investigate, prevent, or take action regarding illegal activities, suspected fraud, or violations of our Terms and Conditions.

5. Data Security

We implement reasonable technical and organizational measures to protect your personal information, including encryption in transit (TLS), hashed passwords, and access controls. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your personal information only as long as necessary to fulfill the purposes described in this policy, or as required by law. Order records are retained for accounting and tax purposes. Phone numbers and message content are retained for a period consistent with the delivery of the Service and then securely deleted.

7. Your Rights

Depending on your location, you may have the following rights regarding your personal information:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate data.
• Deletion: Request deletion of your data, subject to legal retention requirements.

The Service is hosted in the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated.

Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "User") and IT Pro Partner LLC, doing business as Gift-a-Roast ("Gift-a-Roast," "we," "us," or "our"), governing your access to and use of the Gift-a-Roast website, applications, API, phone services, SMS messaging, and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding contract. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

You may browse the Service without an account. To place orders or access order history, you may create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.

3. Service Description

Gift-a-Roast provides AI-generated voice entertainment services, including:

• Gift-a-Roast ($9.99): A personalized AI-generated roast phone call.
• Premium Roast ($19.99): An extended, multi-paragraph personalized roast phone call.
• Sweet Note ($14.99): A personalized AI-generated singing telegram delivered by phone.
• Premium Sweet Note ($24.99): An extended song with premium voice quality.
• Roast + Sweet Bundle ($24.99): Both a roast call and a sweet note.
• Corporate Roast Pack ($49.99): Five roast calls for team or group events.
• The Roast Line ($0.99/min): An interactive phone line where callers are roasted by AI in real time.
• Roast Line Pass ($9.99/mo or $19.99/mo): Subscription plans for unlimited Roast Line access.

All product descriptions and pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

4. Payment & Billing

All prices are in U.S. dollars. Payment is due at the time of order and is processed through Stripe, our third-party payment processor. By placing an order, you authorize us (through Stripe) to charge the provided payment method for the total amount due, including applicable taxes.

Subscription Plans: Roast Line Pass subscriptions renew automatically each month until cancelled. You may cancel at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

Refunds: Due to the digital nature of the Service and the immediate delivery of phone calls, all sales are final. If a call fails to deliver due to a technical error on our part, contact [email protected] within 48 hours for review and potential re-delivery or refund.

5. User Responsibilities & Content

When you submit content to the Service (including "ammo" for roasts, song personalization details, or any other text input), you:

• Retain ownership of the content you submit.
• Grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and transmit your content solely for the purpose of providing the Service (i.e., generating the roast or song you requested).
• Represent that you have all necessary rights to the content you submit.
• Agree that your content will comply with our Acceptable Use Policy.

6. Recipient Consent

You are solely responsible for ensuring that the recipient of any phone call or SMS message has consented to receive the communication. By submitting a phone number, you represent and warrant that:

• The recipient has given you permission to share their phone number for this purpose.
• The recipient has consented to receive the phone call or SMS message.
• You are not submitting the number of any individual who has asked not to receive communications from you or from Gift-a-Roast.
• Your use complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act where applicable.

7. Intellectual Property

The Service, including its original content, features, functionality, design, and underlying code, is owned by IT Pro Partner LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. "Gift-a-Roast" and the Gift-a-Roast logo are trademarks of IT Pro Partner LLC. You may not use our marks without prior written permission.

8. Third-Party Services

The Service integrates with third-party providers including Twilio, ElevenLabs, Deepgram, Stripe, and AI model providers. We are not responsible for the availability, performance, or practices of these third-party services. Your use of the Service may be subject to additional terms from these providers.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-generated content (roasts, songs, lyrics) is produced algorithmically and may contain unexpected, creative, or unconventional output. We do not guarantee that any AI-generated content will meet your specific expectations or be suitable for any particular purpose. Use your judgment when selecting recipients and content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IT PRO PARTNER LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless IT Pro Partner LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) your submission of a phone number without proper consent.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, and indemnification) shall survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Chatham County, Georgia. You consent to personal jurisdiction in these courts.

We reserve the right to modify or replace these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
